Background

The respondent Company introduced changes to their Employer’s Performance Related Pay system. While the Court agreed that a uniform system should apply to all employees the Court recommended that for a period of three years any claimants whose performance was of an acceptable standard would receive a performance payment equal to their average payment received in the previous three years.
