Background

This case concerned the statement of terms and conditions of the Complainant's employment. She received such 18 months after commencing her employment, which is outside the statutory period of two months. A number of the terms contained in such were alleged to be defective. The Complainant was successful at first instance but appealed the quantum of the award for such on the basis that the amount would not have a dissuasive effect as required by the ECJ. However as no detriment, past or future, could be proven the appeal was disallowed.
