Background

This case concerned a claim for outstanding overtime payments. The respondent claimed that in accordance with a collective agreement it had been made clear that the payment of overtime to similarly graded staff would cease immediately. Therefore, the Court found that the Claimant was not entitled to overtime payments, but time-off in lieu as had been agreed.
