Background

This case concerned a claim that the complainant was not promoted despite achieving the criteria laid out for the position. The respondent claimed that although the complainant achieved the necessary quantitative score, he did not achieve the required qualitative scores. The Court reiterated that it does not interfere with the decision of an employer that concerns the merits of candidates. It stated that it will only look behind a decision where a complainant shows that there was unfairness or irrationality in the decision, which was not demonstrated in this case. Accordingly, the claimant's case failed.
