Background

This case concerned a claim by the Plaintiffs for pay parity with a number of employees who are paid red-circled rates of pay. The Court acknowledged that the use of red-circling is not unusual in resolving industrial disputes. The Court felt that as these arrangements are usually introduced due to a change of position of the relevant parties it did not justify similar treatment for the other employees in this instance.
