This case concerned a claim that the Complainant was dismissed by the Respondent on the grounds of gender. She claimed that the parties' relationship had changed after she informed management that she was pregnant. Subsequently, a few months later, she was told that there was no work for her and was let go.
The Respondent claimed that as the business was in a fragile financial position, no position was available for her when she had completed her apprenticeship. The Court held that to disadvantage a woman in employment by reason of her pregnancy is discrimination on the grounds of gender. The lack of evidence in support of the Respondent's position, combined with the gravity of the breach, resulted in the court awarding the compensatory sum of €10,000.
