Genuine Data Subject Access Request (DSAR) Or a Fishing Expedition?

Data subject access requests are routinely used in litigation, often instead of or as a precursor to discovery procedures. What exactly can be refused in a DSAR or discovery request on data protection grounds? What can you do to at least reduce the size/amount of documents?

Duncan Inverarity, Partner, Employment Law Practice Group, A&L Goodbody, explores the grounds on which a DSAR can be refused or reduced, including:

  1. When you can refuse to comply with a request, and how to do it;
  2. What ‘manifestly unfounded’ means;
  3. What ‘manifestly excessive’ means; and
  4. What are the exemptions and how do they work?

Privacy considerations when managing internal investigations

HR professionals can often be faced with complaints, allegations from whistle-blowers and concerns about breaches of policy, which require investigation.  Whilst witness evidence will play one part in any such investigation, with so much activity taking place over instant messaging platforms, text and email, how far can an employer go in securing this material? Does this include personal devices?

Michael O’Doherty, Barrister at Law will discuss:

  1. Scoping an internal investigation to map out the privacy considerations
  2. The DPC guidance on monitoring in the workplace
  3. What approach courts have taken
