Background

This case concerned a Deputy Principal’s challenge to the appointment of another candidate as Principal. The claim was founded on the applicant’s dissatisfaction with the procedures followed by the Boards responsible for selection and appointment of a new Principal. The Court considered the procedures employed and a number of other facts, including an alleged ‘material relationship’ between the notice party and the Chairperson of the Selection Board. The Court ultimately refused the application as no good or sufficient reason was advanced and the Board was entitled to appoint the highest ranking candidate.
