This case involved a claim of unfair dismissal. The claimant had been originally employed by H.M.S. Host Ireland at Shannon Airport but was transferred to the respondent company. The claimant understood he had a permanent contract with his employer. However, he was told by the respondent company that this was not on his personal file. Therefore, the alleged contract was not recognised by the respondent.
The Court found that a high degree of confusion existed around the status of the claimant's employment and that the respondent was responsible for ensuring the contractual position of employees was clear and unambiguous. The Court held that the respondent should recognise that this lack of clarity resulted in a detrimental effect on the claimant and awarded him €5,000 compensation.
