Overview

Child Protection Laws Every Educator Must Know: Understanding Your Legal Duties

The newly implemented Children First Act 2015 as well as the 2017 Procedures provide for a number of key child protection measures.  All school personnel are obliged to follow the Department of Education & Skills’ Child Protection Procedures for Primary and Post Primary Schools 2017 (“DES 2017 Child Protection Procedures”).

In addition to duties under the Children First Act, the 2017 Procedures and the DES 2017 Child Protection Procedures, everyone has a duty under the criminal law to report information on certain specified offences against children and vulnerable persons to An Garda Síochána.

Importance of Training

High-Quality Child Protection Training in Schools is Essential

Children come into contact with teachers more often than any other profession. That’s why high-quality child protection training in schools is essential to ensure the safe development of our children. It also makes sense from a legal point of view helping close down a school’s liability in the event of a child safeguarding matter arising onsite.

The role of school staff in protecting pupils is vital. Children spend more time with teaching and non-teaching staff in school than any other adult group. School personnel are well placed to observe changes in behaviour, lack of development or outward signs of abuse.
