This case involved a claim that the statement of terms of employment issued to the applicant by the respondent did not provide all the information required under the Act. The respondent alleged that any deficiency in the comprehensive statement was minor in nature and of no practical consequence. The applicant admitted that no detriment had been suffered by him and that throughout his employment he had full knowledge of the terms of his employment.
The court reviewed the 11 items which were alleged to have been omitted, and agreed that 5 elements of the complaint were well founded. However, the Court noted the nature of the complaints and the fact they had no practical effect. The Court held that the matter was without substance and trivial. Accordingly, the Court found that the amount of compensation, which was just and equitable in the circumstances, amounted to nil.
