Background

This case concerned a worker’s claim as to her rate of pay. Her claim was on the basis that her wage, when divided by the number of hours she worked, was greatly reduced to less than the statutory minimum wage. The Court held that the Claimant’s evidence was vague and uncertain meaning that the provision could not be provided in the absence of any evidential basis to support the claim.
