
Following on from Linda’s recent checklist on disciplinary procedures, this month Linda has provided subscribers with a template invite letter to be provided to an employee when they are being invited by their employer to a disciplinary meeting.
As is all too clear from recent employment law decisions, the EAT is more and more interested in the procedure used by an employer in dismissing an employee as opposed to the reason for the dismissal itself.
This means it is essential for an employer to keep a full and accurate record of the procedure used and all communications with the employee during the procedure including the information provided to any employee after an investigation has completed and before a disciplinary hearing has taken place.
These documents are essential pieces of evidence that will help an employer in defending a claim of unfair dismissal before a Rights Commissioner or the EAT.
