This appeal concerns the Respondent’s identity. The Equality Tribunal had awarded compensation in favour of the complainant for discrimination and victimisation. However, on appeal the Respondent company proved that the Complainant was in fact employed by a different company which was not party to proceedings. As a result, the Labour Court overturned the Tribunal’s award, despite the evident bona fide mistake of the Complainant in taking the case against the incorrect Respondent.
