
The Complainant commenced employment as a Legal Executive with the Respondent in June 2007. The Complainant earned a net salary of €500 per week but never received any payslips. In July 2016, the Complainant went on sick leave and resigned in January 2019.
The Complainant was not furnished with a written contract of employment before going off sick, but was provided a contract of employment while she was on sick leave which she did not sign, as the terms and conditions did not adequately reflect her working practices in her opinion. The Complainant submitted that she was entitled to annual leave allowances whilst on certified sick leave. The Complainant further submitted that the Respondent failed to maintain the appropriate statutory records pertaining to the employment of her.
The Respondent informed the Complainant that there was no remuneration owing to the Complainant and therefore they considered this matter closed. Further, the Respondent stated that, as a busy office, they simply did not have time to devote any further attention to these queries. The Complainant provided evidence from the Respondent’s Accountant & Taxation Consultants in relation to wages and expenses which stated that payments owing to the Complainant remained outstanding. Accordingly, the Adjudication Officer ordered the Respondent to pay the Complainant compensation amounting to €2,069.92.
