Background

This case concerned a number of alleged contraventions of the Act. The relevant time period for the claim was confined to the standard six month period as the Court held that neither the prior relationship between the parties, nor the claimant's ignorance of her legal rights constituted a reasonable excuse for the delay in taking proceedings. However, the respondent failed to provide any reliable records in relation to the complainant's employment, thus the Court found that the complainant's evidence was not rebutted.
