This case concerned a claim that the complainant was discriminated against in relation to equal pay and conditions of employment. He claimed that comparator Irish workers were paid a higher rate of pay for 'like work'.
The Court stated that the relevant legal principles were similar to those applied in cases involving equal pay between men and women. The Court held that in order for the complainant's claim to be upheld he must prove that the basis for a difference in pay was based on race and/or nationality. The evidence in the case at hand indicated that other indicators were responsible for the differential thus the court held that the difference in pay was objectively justified.
