
The Complainant submitted her complaint to the Labour Court under the Industrial Relations Act. The Complainant submitted that she had been dismissed by the Respondent on the basis that her position was being made redundant. She stated that her position was subsequently advertised and shortly after her position within the company was filled. The Complainant contended that the decision to advertise and subsequently offer her position to another person was contrary to undertakings given at the time of her dismissal as she was not offered re-employment in the first instance. Additionally, the Complainant submitted that her working conditions included working long shifts without requisite rest and inadequate notice of un-rostered call ins to work.
The Respondent in this case failed to attend the hearing and also failed to make any submission to the Court. The Court was satisfied that the Respondent was notified of the date and time of the hearing. After careful consideration of the submissions of the Complainant, the Court recommended that she be compensated by her former employer for the effects of her dismissal and for the failure to offer her re-employment. The Court also took into consideration the inappropriate working conditions afforded to her during her employment. Therefore, the Respondent was ordered to pay the Complainant €4,750.
