Background

This case involved a complaint that the respondent failed to adhere to the complainant's contractual terms and conditions of employment and his legal entitlements. In particular the complainant claimed that the respondent had failed to provide him with information on the timing of his working day.

The Court found that S3(1)(i) of the Act does not require an employer to provide an employee with information of their normal or regular starting times and finishing times in a statement of their terms of employment. Accordingly, the claim failed.
