The facts in the case concerned the inadequate securing of steel coils on the defendant's lorry and trailer, which resulted in the deaths of 2 motorists. The Court held that a fine for €1 million was just and proportionate given the nature of the omissions on behalf of the company and the subsequent harm caused.
