Background

This case concerned a request for an extension of time to bring a claim under the Act. The complainant presented the complaint outside the statutory period of six months. The Court accepted that in certain circumstances such an extension may be granted however the complainant must be able to explain the delay and provide a justifiable excuse for such. However, on the facts the Court held that the complainant had not proved such, therefore the claim failed.
